Terms of Sale and Digital Image License Agreements

Print Store – Terms of Sale

By placing an order through my Pixieset Print Store, you agree to the following Terms of Sale. Please read them carefully before completing your purchase.

1. All Sales Are Final (Custom Products)

All print and product orders are custom-made specifically for you through a professional printing lab (Miller’s Professional Imaging).

Because of the custom nature of these products:

All sales are FINAL

No refunds, cancellations, or exchanges are offered once an order is placed

Please review your selections carefully before submitting your order.

2. Returns & Replacements for Defective Orders Only

If your order arrives with any of the following issues:

  • Printing defects
  • Damage during shipping
  • Incorrect product or image
  • Missing items

You must notify me within 7 days of delivery with:

  • Clear photos of the issue
  • Your order number
  • A brief description of the problem

If confirmed as a lab or shipping error, I will arrange a replacement at no additional cost

Requests submitted after 7 days cannot be honored

Important: You must contact Prasanna Pilaka Photography directly, not Pixieset or the lab.

3. Color & Crop Variations

Please note:

  • Print colors may vary slightly from what you see on your screen due to:
    • Different monitor calibrations
    • Paper type and printing process
  • Some crops may adjust slightly depending on the selected print size and paper ratio
  • The professional lab may make minor print-optimization adjustments for best quality

These variations are normal and not considered defects.

4. Fulfillment & Shipping


All products are professionally printed and fulfilled by a Professional Imaging lab
Pixieset provides the ordering platform only
Shipping times vary based on:

  • Product type
  • Lab production time
  • Carrier delivery timelines

Once an order is in production, it cannot be canceled or modified.

5. Photographer & Lab Limitations of Liability

Prasanna Pilaka Photography and the professional lab are not responsible for:

  • Dissatisfaction due to personal preference
  • Minor color shifts or cropping differences
  • Address errors entered at checkout
  • Print damage after delivery due to mishandling, environmental exposure, or improper storage
     

6. Image Quality & Content Responsibility

You acknowledge that:

  • Images are printed as approved and delivered in your gallery
  • You are responsible for reviewing image selections before ordering
  • Printing copyrighted, unlawful, defamatory, or unauthorized content is prohibited

7. Digital Downloads & Usage License (If Applicable)

If digital downloads are included with your gallery:

You receive a personal-use license only

Images may not be:

* Sold
* Used for commercial advertising
* Altered for resale
* Submitted to publications without written permission

Copyright always remains with Prasanna Pilaka Photography.

 
8. Agreement at Checkout

By completing your purchase through this gallery store, you confirm that:

You have read and agreed to these Terms of Sale

You understand that all products are custom and non-refundable

You agree to contact the photographer—not Pixieset or the lab—regarding any physical product issues

Print Store – Digital Image License Agreement

This Digital Image License Agreement (“Agreement”) outlines the terms under which you are granted permission to use the digital images delivered by Prasanna Pilaka Photography.

By downloading, accessing, or using any digital images, you agree to the following terms:

 
1. Copyright Ownership

All images remain the exclusive intellectual property and copyright of Prasanna Pilaka Photography, even after delivery.

This agreement grants a license to use the images, not ownership of the images themselves.

 
2. Personal Use License (What You ARE Allowed to Do)

You are granted a non-exclusive, non-transferable, personal-use license, which allows you to:

Print for personal use
Display in your home
Share with friends and family or gift them

So long as the images are used only for personal, non-commercial purposes.

3. Prohibited Use (What You May NOT Do)

Without written permission from Prasanna Pilaka Photography, you may NOT:

  • Sell the images
  • Use the images for commercial purposes
  • Use the images for advertising or branding
  • Submit images to magazines, blogs, contests, or publications
  • Alter the images with heavy filters, retouching, or edits that change the artistic style
  • Remove watermarks (if present)
  • Transfer or sublicense the images to third parties
  • Commercial use requires a separate written licensing agreement.

 
4. Social Media & Credit

Customers are encouraged (and always appreciated!) to tag and credit:

@prasannapilakaphotography (or) Photo by: Prasanna Pilaka Photography

when sharing online. This is not legally required but is deeply appreciated.

 
5. Image Integrity & Artistic Style

You agree that:

The final printed images reflect the photographer’s artistic style


6. Archiving & File Storage Responsibility


You are responsible for downloading and backing up your files
Online galleries may expire after the stated delivery window
Prasanna Pilaka Photography is not obligated to store images indefinitely

7. Limitation of Liability

Prasanna Pilaka Photography is not liable for:

* Loss of files due to client failure to download or back up images
* Legal claims arising from unauthorized or unlawful use of the images
* Third-party misuse once files are shared publicly by the client


8. Agreement Confirmation

By downloading, purchasing, or using your images, you confirm that:

You understand these licensing terms

You agree to comply with all usage limitations

You acknowledge that copyright remains with the photographer
